Terms of Service

1. Content Definitions:

  • Blogs: Short to medium-length articles that provide insights, updates, or commentary on a specific topic.

  • White Papers: Detailed and comprehensive reports that address specific topics, providing in-depth research, analysis, and solutions.

  • Thought Leadership Articles: Expert articles that showcase industry knowledge and leadership on a specific topic or field.

  • Newsletters: Regularly distributed publications, often focused on a specific topic or theme, meant for widespread distribution.

  • Email Content: Written material specifically tailored for email communications, including promotional content, updates, and announcements.

  • Social Media Posts: Content created for sharing on various social media platforms, tailored to platform-specific audiences and guidelines.

  • Press Releases: Official statements or communications to the media about company news, events, or announcements.

We do not provide specific word counts for each content type, as the goal of our content is to achieve a specific result, not to meet a set length. Our content will, however, have lengths consistent with industry standards.

2. Onboarding and Initial Communication:

After subscribing to Med Content Pros content bundles, clients must actively participate in the onboarding process. Should a client fail to respond to multiple initial outreach attempts for onboarding within ten (10) business days of subscribing, they agree to forfeit their initial payment, and their subscription will be terminated.

3. Unresponsiveness During Subscription:

In the event that a client becomes unresponsive to multiple outreaches for a period exceeding seven (7) days, Med Content Pros is not obligated to continue to produce content until the client resumes communication. Med Content Pros is also not obligated to produce “catch-up” content to cover content that would have typically been produced during a period of unresponsiveness. If a client remains unresponsive for sixty (60) days or more, their subscription will be automatically canceled.

4. Content Restrictions:

We strive to produce content that maintains the integrity and reputation of both our company and our clients. Med Content Pros reserves the right to refuse any content requests that it deems to be controversial or inappropriate. Controversial topics include health-related topics for which there is significant public or political debate. Med Content Pros reserves the right to make the final determination on whether a content request is controversial or inappropriate. Content requests deemed controversial or inappropriate can be substituted with acceptable content, or the subscription can be refunded.

5. Refund Policy Agreement:

By subscribing to a Med Content Pros content bundle, clients acknowledge and agree to the terms stated in our Refund Policy, which can be found here. Please refer to the Refund Policy for detailed information regarding refunds.

6. Technological Support for Writers:

Clients acknowledge and consent to our use of advanced technology tools, such as content optimization software, language processors, LLM tools, and automated research platforms, to assist our writers in producing top-tier content.

7. Ownership of Produced Material:

Upon full payment, ownership of the content produced by Med Content Pros is transferred to the client unless otherwise specified in these terms or in the Refund Policy. Following a transfer of ownership, the client is responsible for any modifications to the content and for its appropriate use. The client agrees that any attribution of the content to a Med Content Pros writer is only permitted if the content is unchanged from how it was initially produced.

8. Severability:

If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

9. Limitation of Liability:

Neither party shall be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, or data, whether in an action in contract, tort, product liability, strict liability, or otherwise, even if advised of the possibility of those damages. Notwithstanding the foregoing, Med Content Pros' total cumulative liability to the client for all claims arising from or relating to the services provided or this agreement shall not exceed the total amount of fees paid by the client in the last six (6) months.

10. Warranties and Disclaimers:

Med Content Pros represents and warrants that the content provided is unique and will not infringe upon any copyrights or proprietary rights. Except as expressly stated in this agreement, Med Content Pros makes no warranty, express or implied, regarding any matter, including the merchantability, suitability, originality, or fitness for a particular use or purpose of the services provided.

11. Indemnification:

The client agrees to indemnify, defend, and hold harmless Med Content Pros, its officers, directors, employees, and agents from and against all claims, liabilities, damages, and expenses (including reasonable attorney fees and costs) arising out of or related to the client's use, modification, or distribution of the content provided.

12. Termination:

Med Content Pros may terminate this agreement by providing thirty (30) days’ written notice. In the event of a breach of this agreement by the client, Med Content Pros may terminate immediately upon written notice. Clients wishing to terminate their agreement must do so by ending their subscription through their online account or by contacting Med Content Pros directly. No refunds will be provided for subscription payments already made, including unused portions of monthly or annual subscriptions.

13. Confidentiality:

Both parties agree to maintain the confidentiality of all information received from the other party during the course of providing or receiving services unless such information is publicly known or explicitly designated as non-confidential. Med Content Pros reserves the right to make our relationship with the client and any feedback public for marketing purposes unless prohibited by the client in writing.

14. Governing Law & Jurisdiction:

This agreement shall be governed by and interpreted in accordance with the laws of Idaho, USA. Any disputes arising under or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts of Idaho, USA.

15. Amendments:

Any changes or modifications to this agreement must be in writing and signed by both parties.

16. Force Majeure:

Neither party shall be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including, without limitation, acts of God, war, riot, embargoes, acts of civil or military authorities, fire, floods, or accidents.

17. Relationship of the Parties:

Med Content Pros is an independent contractor, and nothing in this agreement shall be construed to create an employer-employee relationship, partnership, or joint venture between the parties.

18. Dispute Resolution:

Any disputes arising out of or related to this agreement shall first be attempted to be resolved through amicable negotiations. If such negotiations fail, parties agree to engage in mediation before resorting to litigation.

19. Client's Obligations:

The client agrees to provide accurate and timely information as required for Med Content Pros to deliver services. The client ensures they have all necessary rights to any materials provided to Med Content Pros and agrees not to provide any materials that infringe on third-party rights.

20. Non-waiver:

Failure by either party to exercise any right or remedy under this agreement does not signify acceptance of the breach or subsequent breaches. No waiver is effective unless it is in writing and signed by the waiving party.
